Today, we received ASHA’s motion to withhold records relating to Alan Balch’s termination of employment. ASHA argues that, even if the Court’s order requires ASHA to produce those records for inspection by the members, ASHA should not be required to produce Records for inspection because ASHA promised Mr. Balch that they would not provide the members with a copy of the settlement agreement with Mr. Balch and other related documents.

On July 28, 2011, ASHA filed a motion for leave to file an amended prehearing statement and extension of time to file its opening brief “from August 15, 2011 until 30 days after [the Concerned Members] file any supplemental prehearing statement.” On August 8, 2011, we filed the Concerned Members’ response in opposition to the motion.
Today we received a copy of the Court of Appeals’s order ruling on ASHA’s motion. A copy of the order is attached to this email. As reflected therein, leave to file an amended prehearing statement has been denied and a small extension of time has been granted. The deadline for ASHA to file its opening brief is now August 30, 2011.

On August 5, 2011, we tendered a proposed order to the trial court reflecting its ruling following the hearings on the motion for ASHA to show cause why it should not be held in contempt. Yesterday, August 9, 2011, the trial court entered the order we tendered. A copy of the order reflecting its entry by the trial court is attached to this email.
The inspection of ASHA’s records remains scheduled to resume on August 15, 2011 at 10:00 a.m. EDT.

June 24, 2011 letter identifying records the ASHA continues to withhold from inspection by the Concerned Members. In the letter, the Concerned Members demand that the ASHA advise, immediately, whether the ASHA will comply with the Court’s Judgment and produce all of the records.
